1. Terms and Conditions for Drive Pro Academy Driving Instructor Services

  2. 1. Lesson Cancellation, Rearrangement and Missed Lesson Policy

    1.1 We require a minimum of 48 hours’ notice to cancel or rearrange any driving lesson.

    1.2 Any lesson cancelled, rearranged, or missed with less than 48 hours’ notice may be charged in full.

    1.3 This is because instructor time has been reserved for the learner and, at short notice, we may be unable to offer that appointment to another learner.

    1.4 This policy applies where:

    a) the learner cancels the lesson;

    b) a parent, guardian, payer, or representative cancels the lesson;

    c) the learner is unavailable at the agreed lesson time;

    d) the learner does not attend;

    e) the learner is late and the lesson cannot reasonably go ahead;

    f) the learner fails to bring a valid provisional driving licence where required;

    g) the learner is not fit to drive due to illness, tiredness, alcohol, drugs, medication, eyesight issues, or any other safety concern;

    h) the learner’s behaviour or condition makes the lesson unsafe or unsuitable to continue.

    1.5 Where Drive Pro Academy cancels a lesson, we will offer a rearranged lesson. If we are unable to provide a suitable replacement lesson, we will refund the lesson fee for the lesson cancelled by us.

    2. Cancellation Communication

    To cancel a lesson, please complete the form https://app.startinfinity.com/form/EXiNi2HyMJ9. We will not acknowledge cancellations through other means.

    3. Punctuality

    It is your responsibility to be on time at the agreed location for your lesson. If you are late, the driving instructor will wait for 15 minutes; after this period, your lesson will be deemed as cancelled and will be fully chargeable. Late arrivals will not extend the lesson, and no refund will be provided for missed time.

    4. Test Eligibility

    Learners will only be presented for the official driving test once they have successfully completed a mock test and have received approval from their instructor. Learners must ensure they meet all DVSA requirements (e.g., valid provisional license) to be eligible for testing.

    5. Consequence of Repeated Late Cancellations

    Orkney Driving Academy reserves the right to withdraw its services at our discretion for learners repeatedly cancelling lessons late.

    6. Advance Payment

    Payment for all lessons is due 48 hours prior to the lesson. Lessons for which payment is not received in this timeframe will be cancelled, with no grace period unless agreed in advance.

    7. Fast Track Courses

    • 7.1 Your Fast Track Course has a fixed fee which covers the cost of lesson fees, use of car for pre-test lesson, use of car for test, practical driving test fees, administration and preferential lesson slots.
    • 7.2 We advise that you take your theory test before or as soon as you begin driving lessons, however, you are able to begin regular driving lessons and Fast Track 40 lessons before you have passed your theory test. You are not however able to register on Fast Track 20 or 30 until you have passed your theory test.
    • 7.3 Fast Track Courses can have up to six hours of lessons a week, subject to availability.
    • 7.4 We will schedule all but two of your Fast Track lessons. The final two are held back for your pre-test lesson and test hour.
    • 7.5 Fast Track Cancellations and Refunds:
      • 7.5.1 If you decide not to go ahead with your Fast Track Courses once a deposit has been paid and no lessons have been taken, we will refund your deposit to you, minus a £60 admin fee.
      • 7.5.2 If for any reason you decide not to complete your Fast Track Course, you are entitled to a refund of any lessons not used at the standard hourly rate at the time of purchase for your instructor, plus the current DVSA test fee from the original fee you paid.
      • 7.5.3 Any lessons within 48 hours of the cancellation date are non-refundable.
      • 7.5.4 Test fees are non-refundable within three working days of the test date.
      • 7.5.5 Fast Track Courses adhere to the the rest of these terms and conditions

    8. Driver Conduct and Respect
    Learners must adhere to:

    • 8.1 Respect for Other Road Users: Learners are required to drive with consideration and respect for other road users, including adhering to road signs, signals, and avoiding aggressive driving behaviors.
    • 8.2 Respect for Instructors and Vehicles: Learners must also show respect towards their instructors and the vehicles they are driving. This means following the instructor’s guidance and taking care of the vehicle.
    • 8.3 Termination of Lesson: If a learner does not drive with the required respect for other road users, the instructor, or the vehicle, Orkney Driving Academy reserves the right to terminate the lesson immediately. This decision is at the sole discretion of the instructor.
    • 8.4 Adhering to all of our Terms and Conditions, including but not limited to Section 15: Honesty & Integrety, Section 16: Insurance & Compliance and Section 14: Health & Safely Clauses .
    • 8.4 Repeated Offenses: Should a learner repeatedly fail to adhere to these standards, Orkney Driving Academy reserves the right to withdraw services at its discretion. This includes cancellation of future lessons and refusal of services.

    9. Offers of Lessons

    Once you are at the top of your respective waiting list, we will contact you to offer lessons using the details provided when you joined the waiting list. This offer will remain open for 48 hours. If you have not replied to accept our offer within this timeframe, your slot will be offered to another learner.

    10. Theory Tests

    • 10.1 You must pass the DVSA Theory Test before a Practical Driving Test can be booked.
    • 10.2 All Theory Tests must be booked directly by you through the official DVSA service at www.gov.uk/book-theory-test. Orkney Driving Academy does not book Theory Tests on behalf of learners and is not involved in the booking process.
    • 10.3 We strongly advise against using third-party or unofficial websites to book your Theory Test, as these may charge additional fees or breach DVSA terms.
    • 10.4 We can support your preparation for the Theory Test through our online learning materials, courses, and guidance, but responsibility for booking and attending the test rests entirely with you.
    • 10.5 If the DVSA cancels or rearranges your Theory Test, you must follow their instructions for re-booking. Orkney Driving Academy operating as Drive Pro Academy cannot be held liable for any delay, loss, or inconvenience arising from DVSA actions or system availability.
    • 10.6 If you need to cancel or reschedule your Theory Test, you must do so at least 10 working days before the scheduled date to avoid losing your test fee, in line with DVSA rules.
    • 10.7 Orkney Driving Academy operating as Drive Pro Academy accepts no responsibility for DVSA delays, IT failures, or other force majeure events beyond our control that may affect your ability to take the test on the planned date.

    11. Practical Driving Tests

    • 11.1 You must hold a valid Theory Test Pass Certificate before we will book your Practical Driving Test with the DVSA.
    • 11.2 For pupils enrolled on our Fast Track 20, 30 or 40 hour courses, the DVSA Practical Test fee and a small admin fee is included in the course price. For all other pupils, we will charge the current DVSA test fee at cost.
    • 11.3 Your instructor will only authorise a test booking once you have completed a mock test and been confirmed as ready. We will assist in securing the earliest suitable DVSA test date, but availability depends entirely on the DVSA system and cannot be guaranteed within a fixed timeframe.
    • 11.4 We may, with your consent, book a test slot on your behalf using your DVSA login details. This booking will always be made in your name, for your personal use, and never held or sold to another learner. You must not amend, move or cancel the test through the DVSA system without first consulting us. If you alter or cancel a test without agreement and this results in additional costs (for example, a late-cancellation charge), we reserve the right to recover those costs from you.
    • 11.5 Before attending your test, you must meet the DVSA’s ‘Are You Ready to Pass?’ requirements. We will share these with you at least seven days before your test and you must confirm that you meet them.
    • 11.6 We operate according to the DVSA’s ethical booking practices. We will never book or retain test slots for learners we are not actively teaching, nor use any automated or third-party “cancellation” or “slot-finding” services. Using such services independently may breach DVSA terms and could result in your test being cancelled.
    • 11.7 If you cancel or move your DVSA test within 10 working days of the scheduled date, you will forfeit the test fee unless the DVSA accepts your reason as an emergency or exceptional circumstance. Any subsequent rebooking will require payment of a new test fee.
    • 11.8 If the DVSA cancels or rearranges your test (for example, due to examiner shortage, industrial action, or test-centre closure), we will assist you in securing a new date, but we cannot accept liability for losses or inconvenience arising from DVSA decisions or delays.
    • 11.9 Orkney Driving Academy operating as Drive Pro Academy  cannot be held responsible for systemic DVSA delays or force majeure events beyond our control, including but not limited to changes in national policy, weather-related closures, or IT system outages affecting test availability.

    12. Data Protection

    Orkney Driving Academy operating as Drive Pro Academy collects and processes personal data in compliance with the UK General Data Protection Regulation (GDPR). Your data will be used solely for the purposes of lesson scheduling, communications, and invoicing. Your information will not be shared with third parties without your consent, except where required by law. You have the right to request access to your data and request its deletion at any time.

    13. Liability

    • 13.1 Orkney Driving Academy operating as Drive Pro Academy holds appropriate insurance to cover accidents or incidents during driving lessons. Learners are not held liable for damages unless caused by willful misconduct or negligence.
    • 13.2 Engaging in unlawful driving that voids the instructor’s insurance, including but not limited to failing to disclose required medical conditions to the DVLA, is strictly prohibited. 

    14. Health and Safety – these apply to all learners on Fast Track and Regular Lessons

    • 14. 1. Learner Responsibility
      • 14.1.1 Learners must comply with all road safety rules and ensure they meet the DVSA’s official criteria for being fit to drive in England, Wales, and Scotland.
      • 14.1.2 The latest DVSA requirements can be found here and cover aspects such as vision, medical conditions, medication/drugs, fatigue, and general fitness to drive.
      • 14.1.3 Learners must disclose to their instructor, any medical conditions, medication use, or other factors that may affect their ability to drive safely. That includes all medication listed here.  If an instructor has reason to believe a learner is not fit to drive, the lesson will be terminated immediately, and the learner will not be eligible for a refund. 
    • 14.2. Fitness to Drive
      • 14.2.1 Learners must not attend a lesson if they are unwell, excessively fatigued, or under the influence of alcohol, drugs (including prescription medication that impairs driving), or any other substance that could impair their driving ability. Please consult the list of medication/drugs that may impair ability to drive to ensure you are not taking any of them and disclose them to your instructor immediately if you are. Failure to do this could result in your lessons being terminated.
      • 14.2.2 If an instructor has reason to believe a learner is not fit to drive, the lesson will be terminated immediately, and the learner will not be eligible for a refund.
    • 14.3. Eyewear and Vision Requirements
      • 14.3.1 Learners must meet the legal eyesight requirements as per the DVSA regulations.
      • 14.3.2 If a learner requires glasses or contact lenses to meet these requirements, they must wear them during the lesson.
      • 14.3.3 If a learner arrives without required corrective eyewear and cannot meet the DVSA eyesight standard, the lesson will be terminated immediately, with no refund issued.
    • 14.4. Vehicle Safety and Instructor Authority
      • 14.4.1 Learners must follow all instructor instructions regarding road safety and vehicle operation.
      • 14.4.2 If a learner engages in reckless, dangerous, or intentionally unsafe driving, the instructor reserves the right to terminate the lesson immediately.
      • 14.4.3 In such cases, no refunds will be issued, and Orkney Driving Academy may refuse to provide further lessons.
    • 14.5. Termination of Services

    Orkney Driving Academy operating as Drive Pro Academy reserves the right to permanently cease lessons for any learner who repeatedly fails to meet health and safety requirements, with no refunds issued for prepaid lessons or packages.

    15. Honesty and Integrity
    Providing false or misleading information to an instructor, particularly in relation to medical conditions, medication use, or fitness to drive, is considered a serious breach of our terms and conditions. If a learner is found to have intentionally misled their instructor, lessons may be permanently terminated with no refund issued.

    16. Pricing and Payment

    1. Lesson Prices

    • Lesson and course prices are reviewed regularly and may be subject to change.
    • Price changes will apply to all new bookings made after the effective date of the change.
    • Any lessons or block bookings already paid for prior to a price change will be honoured at the rate at which they were purchased.

    2. Instructor Rates

    • Prices may vary between instructors, reflecting their qualifications and experience.
    • Orkney Driving Academy reserves the right to set different rates for individual instructors and courses.

    Notice of Changes

    • Where possible, at least 14 days’ notice will be given of any price increase.
    • Notice will be communicated via email to all learners and published on our website.

    Fast Track Courses

    • Fast Track course fees include the DVSA driving test fee and a pre-test lesson.
    • Course prices vary depending on the instructor delivering the lessons.

    17. Insurance and Legal Compliance
    Engaging in unlawful driving that voids the instructor’s insurance, including but not limited to failing to disclose required medical conditions to the DVLA, is strictly prohibited. Any learner found to have participated in such actions will be removed from our services immediately, with no refund issued for prepaid lessons or courses.

    18.  Refund Policy
    Refunds will not be provided to learners who are removed from our services due to breaches of health and safety policies, dishonesty, or legal non-compliance. Any refund requests will be assessed based on our discretion and the circumstances of the cancellation.

    19. Modifications to Terms

    These terms and conditions may be updated from time to time. Orkney Driving Academy operating as Drive Pro Academy will notify learners of any major changes. Learners are encouraged to review these terms regularly on our website.

Drive Pro Academy is a Service based business Website available at www.driveproacademy.co.uk (the “Website.”) Orkney Drive Academy and its affiliates (“we”, “us” or “our”) grant access to the Website to you subject to these terms (the “Terms of Use”). Products or Services.

The following terms in these Terms of Use are applicable to those who make any purchase through the Website.

  1. Product/ Service Descriptions. It is our intention and efforts to put accurate product information, descriptions, and images on the Website. However, it is your responsibility to fully vet any product or service prior to purchase. We are not responsible for any mistakes, omissions, or inferences made from product or service descriptions. Descriptions may be changed by us at any time without notice.
  2.   Prices for our products and services may change at any time without notice. We are under no obligation to honour a previously posted price for a purchase. Prices for delivery (if applicable) and or tax (if required by law) are not included in the price and will be charged to the purchaser at the time of purchase. Payment is due upon placing an order unless alternative payment arrangements are agreed in writing. Acceptable payment methods are disclosed on the checkout page.
  3.   We may modify or discontinue any product or service without notice at any time.
  4.   We reserve the right to refuse a sale to anyone at our sole discretion.
  5. Recurring payments are taken from the credit card you used to register. You can keep track of your payments and payment date on your account page. 
  6. Termination by you: You may cancel your membership at any time through your account page.  You will have access to the membership until the period you have paid for has completed. Cancellations made less than one week before the recurring date of your membership may result in payment being taken for the following month. Note that if you cancel your membership, you are no longer able to take advantage of the ‘Instructor Access Guarantee’ offer.
  7. Termination by Orkney Driving Academy: We reserve the right to revoke your membership with us at any time at the company’s discretion.
  8. Refunds: No refunds are given for previous months. In the case of periods of all content being unavailable for more than three working days in the current month, please contact us here to receive a partial refund in the current month. 
  9. Instructor Access Guarantee: You will be offered driving lessons within 3 months of joining our paid premium membership. Should you cancel your membership inside this year, you will revert to your original place on the waiting list.

Promotions, Sweepstakes, and other Contests.

We may offer special promotions, contests, and/or sweepstakes intended to provide you an incentive to use, engage with, or promote the Website and/or purchase our products or services. The applicable rules will be posted on the Website in or near the description of each such promotion. We reserve the right to interpret the rules related to any such promotion, contest, or sweepstakes in our sole discretion, and you agree to our interpretation.

 

General Maintenance.

We may make the website unavailable for periods of time for general maintenance, or for any reason we deem appropriate. We make no guarantee as to a length of time the website may be unavailable. We are not liable to you for any issue that may arise from the Website’s unavailability.

 

Termination.

Terms and Conditions for Online Learning Portal Memberships and Products

  • Intellectual Property
    All membership and product content remains the intellectual property of Orkney Driving Academy at all times. We retain all rights to all digital materials. You are strictly prohibited from copying, sharing, or distributing any content in any form without prior written consent.

  • Content Changes
    We reserve the right to update, change, or remove content within your membership or product at any time. The minimum content for each tier will be stated on the sign-up page and will remain available for as long as you hold an active membership for that tier.

  • Payments
    Recurring payments will be taken from the card you used when registering, unless you update your payment method in your account. You can view your payments and renewal dates on your Purchase History page.

  • Cancellation by You
    You may cancel your membership at any time via your account settings. Your access will remain active until the end of the period you have paid for. Cancellations made less than seven days before your renewal date may still result in the next payment being taken. As per clauses 7 and 8, once you cancel your membership you will no longer qualify for the ‘Instructor Access Guarantee’.

  • Refunds
    Payments are non-refundable for previous periods. If all membership content is unavailable for more than three consecutive working days in your current billing period, please contact us to request a partial refund for that month.

  • Cancellation by Orkney Driving Academy
    We reserve the right to suspend or cancel your membership at our discretion. Where possible, we will provide notice and a pro-rata refund for any unused period, except where termination is due to a breach of these Terms.

  • Access
    Provided your payments are up to date, you will have access to your membership for as long as it is offered. If we decide to close the membership, we will give you reasonable notice.

  • Instructor Access Guarantee (Orkney Premium Membership only)
    If you join Orkney Premium Membership, you will be eligible for driving lessons to begin within three months of joining, subject to lesson availability. If you cancel your membership within this period, you will return to your original place on the waiting list. Lesson dates, times, and vehicle type will be allocated at our discretion. To be eligible, you must add yourself to the waiting list at the time of registering for your paid membership if you have not already done so.
